Please read these Terms of Service ("Terms") carefully before using the CyberDental Secure Card Authorization Platform operated by CyberDental Group ("we," "our," or "us"). By accessing or using our service, you agree to be bound by these Terms.

1. Agreement to Terms

By accessing or using the CyberDental card authorization platform ("Service"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using this Service.

2. Description of Service

CyberDental provides a secure platform that enables:

  • Cardholders: To submit encrypted credit card authorization forms to dental practices
  • Dental Practices: To securely store and access card authorizations for processing payments

The Service uses industry-standard encryption (RSA-4096 + AES-256-GCM) to protect cardholder data and is designed to comply with PCI DSS requirements.

3. User Responsibilities

For Cardholders

When submitting a card authorization, you agree to:

  • Provide accurate and complete information
  • Only authorize cards that you are legally permitted to use
  • Review and understand the authorization terms before submission
  • Keep your reference code secure for your records

For Dental Practice Users (Admin)

When accessing the administrative portal, you agree to:

  • Maintain the confidentiality of your login credentials
  • Only access cardholder data for legitimate business purposes
  • Comply with PCI DSS requirements and all applicable laws
  • Report any security incidents immediately
  • Not share, export, or misuse cardholder information

4. Authorization and Consent

By submitting a card authorization through our platform, you:

  • Authorize the specified dental practice to charge your card for dental services
  • Consent to the secure storage of your encrypted card information
  • Acknowledge that authorizations may be used for recurring charges if specified
  • Understand that you can request revocation by contacting the dental practice

5. Acceptable Use

You agree NOT to:

  • Use the Service for any unlawful purpose or in violation of any regulations
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service's security features
  • Submit fraudulent or stolen card information
  • Use automated systems to access the Service without permission
  • Attempt to decrypt, reverse engineer, or circumvent security measures
  • Transmit malicious code, viruses, or harmful data
  • Misrepresent your identity or authority to authorize payments

6. Security Measures

We implement comprehensive security measures including:

  • Client-side encryption of all card data before transmission
  • RSA-4096 + AES-256-GCM hybrid encryption
  • Secure, audited access to decrypted data
  • Rate limiting and brute force protection
  • Session management and authentication controls

While we employ industry-leading security practices, no method of transmission or storage is 100% secure. You acknowledge and accept this inherent risk.

7. Intellectual Property

The Service and its original content, features, and functionality are owned by CyberDental Group and are protected by international copyright, trademark, and other intellectual property laws. You may not:

  • Copy, modify, or distribute any part of the Service
  • Use our trademarks or branding without written permission
  • Create derivative works based on the Service

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may:

  • Temporarily suspend the Service for maintenance or updates
  • Modify or discontinue features with reasonable notice
  • Restrict access in response to security threats

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be error-free or uninterrupted
  • Defects will be corrected immediately
  • The Service is free of viruses or harmful components
  • The results of using the Service will meet your requirements

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CYBERDENTAL GROUP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid us (if any) in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless CyberDental Group, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from:

  • Your use or misuse of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any fraudulent or unauthorized use of payment cards

12. Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including:

  • Breach of these Terms
  • Fraudulent or illegal activity
  • Security concerns
  • At the request of law enforcement

Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination shall survive.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Delaware.

14. Dispute Resolution

Before initiating any legal action, you agree to first attempt to resolve any dispute informally by contacting us. If we cannot resolve the dispute within 30 days, either party may proceed with formal dispute resolution.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by:

  • Posting the updated Terms on this page
  • Updating the "Last Updated" date
  • Notifying admin users via email for significant changes

Your continued use of the Service after changes constitutes acceptance of the modified Terms.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and CyberDental Group regarding the Service and supersede all prior agreements and understandings.
